A major pharmaceutical company is set to file a petition with the U. S. Securities and Exchange Commission (SEC) challenging the company’s ability to sell its blockbuster heartburn drug Nexium, which it’s said is on the market.
The petition, which is filed under the Securities Exchange Act of 1934, alleges that AstraZeneca’s Nexium, marketed as Prilosec, is a “pharmaceutical product used to treat high blood pressure” and has “no demonstrated clinical benefits.”
The company said its Nexium petition will be a “complete, non-cessive” response to the lawsuit filed by the U. Judicial Panel on Multidistrict Litigation (JPML) against the generic-drug maker and its competitors in this case.
“We intend to continue pursuing this and other matters related to Nexium in the future,” the petition reads. “The petition will serve as an important public record as it reflects our determination that the drug is not therapeutically equivalent to the marketed product.”
The petition is headed “Useful to Warn All Consumers: Nexium (esomeprazole) for Heartburn.” It was first filed in 2001 in the U. District Court for the Northern District of Florida, and has since been transferred to the U. Judicial Panel on Multidistrict Litigation in Philadelphia.
The U. District Court for the Northern District of Florida, however, has not decided whether to transfer the case to the JPML, or the JPML itself.
The petition says that Nexium is a “pharmaceutical product used to treat high blood pressure, heartburn, or other gastrointestinal conditions,” and is “not likely to have commercial or other significant benefits for consumers.”
According to the petition, “Nexium is a safe and effective drug that may have demonstrated therapeutic benefits that do not exist or that the treatment may cause serious side effects.”
The company said the petition also claims that “there was no clinically significant safety risk from Nexium.”
The company, however, is not alone.
AstraZeneca, the manufacturer of Prilosec, agreed in late 2002 to pay $9.2 billion to resolve the litigation, which is the first of its kind in the country.
The lawsuit was filed in the United States District Court for the Northern District of Florida, in the first instance, and is pending in the United States District Court for the Eastern District of Pennsylvania. AstraZeneca has not responded to the JPML’s petition, and the company is scheduled to pay $1.1 billion to resolve the litigation.
The JPML petition follows a similar lawsuit filed in the United States District Court for the Eastern District of Pennsylvania in 2002, in which the company claimed that AstraZeneca failed to warn consumers of the “potential risks” of Nexium. The petition was filed under the Securities Exchange Act of 1934, the federal Securities Act of 1933, the Securities Exchange Act of Marion R. III, and the Securities Act of 1933.The JPML also filed a lawsuit in the United States District Court for the Eastern District of Pennsylvania in 2002, in which the company claimed that AstraZeneca knew or should have known that Prilosec, like other Nexium products, could cause serious side effects. The lawsuit is set to go to trial in the United States District Court for the Eastern District of Pennsylvania, and the case is set to be certified for trial in the United States District Court for the Northern District of Florida.
In October 2010, the U. Judicial Panel on Multidistrict Litigation (JPML) decided that the petition should be certified for pretrial use, and that the case should be tried in the United States District Court for the Eastern District of Pennsylvania.
